Wisy Privacy Policy

This Privacy Policy is designed to explain how Wisy Platforms, Inc. collects, uses, and shares information gathered through our Wisy platform (including https://wisy.ai and any other site that links to this Privacy Policy), and our mobile applications, including Wisy (collectively, the “Services”). The terms “Wisy,” “we,” and “us” include Wisy, Inc., our affiliates and subsidiaries. By using the Services, you agree to the terms and conditions of this Privacy Policy.

Information We Collect
Information You Provide Us

Specifically, we collect the following categories of data (which, if it could be used to identify a specific person, or is linked to such identifying data, will be deemed as “Personal Data”): 

  1. Data received from you.  You directly provide our Company with most of the data we collect: 

Sign-On Information: Your organization (our customer) can create an account with Wisy Platforms, Inc. for you, using an email and mobile number. When they do, we will receive information from your organization, including your:

  • Name
  • Email address
  • Phone number
  • Demographic information, such as gender and nationality
  • Profile Picture

Communications. If you contact us directly, we may receive additional information about you. For example, when you contact customer support, we may receive your name, email address, phone number, the contents of a message or attachments that you may send to us, and other information you choose to provide.

  1. Data received from our Customers.  Customers may also provide us with data concerning their users, in order to enroll such users to our services.  Such data usually refers to the user´s first names/nicknames and work emails, however additional data may be provided at the Customer’s discretion.
  1. Data in Photographs.  Users may use the App in order to photograph and upload images of products, invoices or receipts, and other details that appear on the invoice or receipt (SKUs, QR codes, etc.)
  1. Data about locations.  Our services may also collect and use your location to prevent fraud and provide certain functionality of our services.
  1. Data Automatically collected or generated.  When you use our Services, we receive your precise location information. We may also collect the precise location of your device when our applications are running in the foreground or background or when the app is closed. We use your location information while you are using our services. We also infer your more general location information (for example, your IP address may indicate your more general geographic region). 

When you use our Services, we and our third-party service providers may collect information from you through automated means, such as cookies, web beacons, and web server logs. By using the Services, you consent to the placement of cookies, beacons, and similar technologies in your browser and on emails in accordance with this Privacy Policy. The information collected in this manner includes IP address, browser characteristics, device IDs and characteristics, operating system version, language preferences, referring URLs, and information about the usage of our Services.

We may use this information, for example, to ensure that the Services function properly, to determine how many users have visited certain pages or opened messages or newsletters, or to prevent fraud. We work with analytics providers such as Google Analytics, which uses cookies and similar technologies to collect and analyze information about use of the Services and report on activities and trends. This service may also collect information regarding the use of other websites, apps and online resources. How We Use Your Information

We may use the data we collect: 

  • To operate, maintain, enhance and provide features of the Services, to provide services and information that you request, to respond to comments and questions, and otherwise to provide support to users.
  • To understand and analyze the usage trends and preferences of our users, to improve the Services, and to develop new products, services, features, and functionality.
  • To contact you for administrative and informational purposes, and to contact individuals whom you invite to join the service.  This may include providing customer service or sending communications, including changes to our terms, conditions, and policies, or invitations to join the service. 
  • For marketing purposes, such as developing and providing promotional and advertising materials that may be useful, relevant, valuable or otherwise of interest.
  • To personalize your experience on the Services by presenting products and offers tailored to you.
  • We may aggregate data collected through the Services and may use and disclose it for any purpose.
  • For our business purposes, such as audits, security, compliance with applicable laws and regulations, fraud monitoring and prevention.
  • To enforce our Terms of Service or other legal rights.

How do we store your data

Data Location. Our Company securely stores your data at Amazon AWS and Google Cloud Engine in the United States and other jurisdictions, as necessary for the proper delivery of our services, or as may be required by law.

While privacy laws may vary between jurisdictions, Wisy and its subsidiaries and Service Providers are each committed to protect Personal Data in accordance with this Privacy Policy and customary industry standards, regardless of any lesser legal requirements that may apply in such jurisdictions.

Data Retention.  We retain Users’ Personal Data for as long as their related Customer’s agreement with us is in effect, or for as long as their account is active, and we have not been notified otherwise, or as long as we consider necessary for the purposes described herein. We keep Visitors’ Personal Data for as long as we reasonably need in order to maintain and expand our relationship and to provide them with our Services.

We will also retain your Personal Data for as long as is required in order to comply with our legal and contractual obligations, or to protect ourselves from any potential disputes (i.e. as required by laws applicable to records and bookkeeping, as necessary for allowing the Users you engaged with via our Services to meet their own obligations or legitimate needs, and in order to have proof and evidence concerning our relationship, should any legal issues arise following your discontinuance of use), in accordance with our data retention policy.

Please note that except as required by applicable law, we will not be obligated to retain your Personal Data for any particular period, and we are free to securely delete it for any reason at any time, with or without notice to you. How We Share Your Information

We disclose information that we collect through the Services to third parties in the following circumstances:

  • To our third-party service providers who provide services such as website hosting, payment processing, data analysis, information technology and related infrastructure provision, customer service, email delivery, online advertising, auditing, and other services.
  • We may use third-party advertising companies to serve advertisements regarding goods and services that may be of interest to you. To do so, these companies may set and access their own cookies, pixel tags, and similar technologies on our Services and they may otherwise collect or have access to information about you which they may collect over time and across different online services.  Some of our advertising partners are members of the Network Advertising Initiative or the Digital Advertising Alliance. If you do not wish to receive our personalized ads, please visit their opt-out pages to learn about how you may opt out of receiving personalized ads from member companies. 
  • We may publicly display comments and testimonials we receive from users. If you write a comment, send us an email, or other communication, we may edit it at our discretion and use it, with or without your name, anywhere we desire, including, but not limited to, our website(s), press releases, newsletters and marketing material.
  • To a potential or actual acquirer, successor, or assignee as part of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in bankruptcy or similar proceedings). 
  • If required to do so by law or in the good faith belief that such action is appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

We may use and disclose aggregate information that does not identify or otherwise relate to an individual for any purpose, unless we are prohibited from doing so under applicable law. 

Third Party Services

This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including any third party operating any site or service to which the Services link. The inclusion of a link on the Services does not imply endorsement of the linked site or service by us or by our affiliates.

Data Security

We use certain physical, organizational, and technical safeguards that are designed to maintain the integrity and security of information that we collect. Please be aware that no security measures are perfect or impenetrable and thus we cannot and do not guarantee the security of your data. It is important that you maintain the security and control of your account credentials, and not share your password with anyone.

Your Choices

From time to time, we send marketing e-mail messages to our users.  If you no longer want to receive such emails from us on a going forward basis, you may opt-out via the “unsubscribe” link provided in each such email.

You can prevent your device from sharing precise location information at any time through your device´s operating system settings.  However, location is the core for monitoring certain activities.

Data Subject rights

If you wish to exercise your rights under any applicable law, including the EU General Data Protection Regulation (GDPR), to request access to, and rectification or erasure of your Personal Data held with Wisy, or to receive  a portable copy of such Personal Data – please contact us by email at legal@wisy.ai.

Children’s Privacy

We do not knowingly collect, maintain, or use personal information from children under 13 years of age, and no part of the Service is directed to children. If you learn that a child has provided us with personal information in violation of this Privacy, then you may alert us at legal@wisy.ai

Your California Privacy Rights

You have a right to choose whether we share your personal information with third parties for their own marketing purposes.

Pursuant to California Civil Code Section 1798.83, California residents who provide us with personal information in obtaining products or services for personal, family, or household use are entitled to request and obtain from us, one time per calendar year, information about the customer information we shared, if any, with other businesses for their own direct marketing uses. Alternatively, the law provides that a company may comply, as Wisy does, by disclosing in its Privacy Policy that it provides consumers choice (opt-in or opt-out) regarding sharing Personal Information with third parties for those third parties’ direct marketing purposes, and information on how to exercise that choice. As stated above in this Privacy Policy, Wisy provides you choice prior to sharing your personal information with third parties for their direct marketing purposes. If you do not opt-in or if you choose to opt-out at the time Wisy offers that choice, Wisy does not share your information with that identified third party for its direct marketing purposes.

International Cross-Border Data Transfer

Wisy uses servers hosted in the United States. Please note that we may be transferring your information outside of your region for storage and processing in the United States, Latin America, and around the globe. By using the Services, you consent to the transfer of information to countries outside of your country of residence, including the United States, which may have data protection rules that are different from those of your country.

Updates to This Privacy Policy

We may make changes to this Privacy Policy. The “Effective Date” date at the top of this page indicates when this Privacy Policy came into effect. If we make material changes, we may notify you through the Services or by sending you an email or other communication. We encourage you to read this Privacy Policy periodically to stay up-to-date about our privacy practices. Your use of the Services following these changes means that you accept the revised Privacy Policy.
